Now, over 23 states have legal adult use or recreational delta-9 THC. So, how is it that delta-9 THC gummies are being sold online and in states even without this legalization? 

It comes down to hemp-derived vs. cannabis-derived THC. While cannabis-derived THC is only legal in the states referenced above, due to the 2018 Farm Bill the cannabinoids produced by hemp plants (including up to 0.3% delta-9 THC) are legal federally.
